TERMS & CONDITIONS
Last Updated: September 25, 2025
1. Acceptance of Terms
By accessing or using this website (the “Site”) and any services offered via the Site (including but not limited to ordering, consultations, refills, etc.), you accept and agree to be bound by these Terms & Conditions (“Terms”), our Privacy Policy, HIPAA Notice (if applicable), and any additional terms or policies posted on the Site. If you do not agree to these Terms, do not use the Site.
2. Eligibility & Licensing
-
You must be at least 21 years old (or of legal age in your jurisdiction) to use this Site.
-
Services offered by this Site (or through The Compounding Lab) are available only in states where the pharmacy is properly licensed and meets regulatory requirements (e.g., Tennessee, North Carolina, Georgia, Florida).
-
If you request or receive services from a state in which we are not licensed, we reserve the right to decline or cancel those services.
3. Services / Products
-
The Site provides access to compounding pharmacy services (human and veterinary), prescriptions, consultations, refills, and other medical or health-related offerings.
-
All orders are subject to review, approval, and availability. We reserve the right to refuse or cancel orders for any reason, including regulatory compliance, prescription verification, or insufficient information.
-
You agree to provide accurate, current, and complete information as required (e.g. medical history, prescriptions, veterinary data).
-
Use of compounded medications should follow the directions of your prescribing provider. The Site is not a substitute for professional medical or veterinary advice.
4. Prescription Verification & Safety
-
All prescriptions must be valid, current, and issued by a licensed prescriber authorized to prescribe in your jurisdiction.
-
We reserve the right to contact the prescriber for clarification, verification, or other necessary inquiries.
-
You acknowledge that compounded medications may carry risks, and you will notify your prescriber and us of any adverse reactions or concerns immediately.
5. Payment, Billing & Insurance
-
You agree to pay all charges for services you order through the Site, including applicable taxes, shipping, handling, and compounding fees.
-
Payment is due at the time the order is placed (unless otherwise specified).
-
We may accept or deny insurance claims at our discretion. You are responsible for verifying coverage, submitting claims, and handling disputes with your insurer.
-
In the event of a refund, credit will be issued in accordance with our refund policy (if any).
6. Shipping, Delivery & Risk
-
We will make reasonable efforts to ship or deliver medications in accordance with the schedule provided.
-
You bear the risk of loss or damage once the products leave our facility (or our shipper).
-
If a package is lost, stolen, or delayed, you must notify us promptly so we can attempt resolution with the carrier.
-
Some compounded medications may require special handling (e.g. refrigeration) — you agree to properly store and handle upon receipt.
7. Representations & Warranties
-
You represent and warrant that (a) you are legally permitted to receive the medications in your jurisdiction, (b) you will use them only as directed, and (c) you will not distribute or resell them.
-
We disclaim all warranties, express or implied, except as required by law. To the fullest extent permitted, we disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
-
To the fullest extent permitted by law, in no event shall we, our affiliates, officers, employees, or agents be liable for indirect, incidental, special, punitive, or consequential damages, or damages for loss of profits, data or use, arising from your use (or inability to use) the Site or the services, even if advised of the possibility of such damages.
-
Our aggregate liability to you for any claim arising from these Terms or your use of the Site shall not exceed the fees you paid to us for the particular order or service giving rise to the claim (or, if none, a nominal amount such as USD 100).
9. Indemnification
You agree to defend, indemnify, and hold harmless The Compounding Lab, its affiliates, licensors, and service providers, and their respective officers, directors, employees and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to (a) your violation of these Terms, (b) your misuse of the Site, (c) your violation of any third-party rights, or (d) your negligence or willful misconduct.
10. Intellectual Property & Use Restrictions
-
All content, text, graphics, logos, images, software, and other materials on the Site (“Content”) are the property of The Compounding Lab or its licensors and protected by copyright, trademark, and other intellectual property laws.
-
You may view, download, or print Content for your personal, noncommercial use only, provided you retain all copyright and other proprietary notices.
-
You may not use, reproduce, distribute, modify, publicly display, or exploit Content for commercial purposes without prior written permission.
11. Third-Party Links & Resources
-
The Site may include links to third-party websites, resources, or services. These are provided solely for convenience, and we are not responsible for their content, accuracy, or availability.
-
Your interactions with third parties (including insurance, providers, delivery services) are solely between you and those parties.
12. Privacy, HIPAA & Confidentiality
-
Use of the Site may involve transmission or collection of Protected Health Information (PHI). Our handling of that information is governed by our Privacy Policy and HIPAA Notice, which you should review carefully.
-
By using the Site, you consent to the collection, use, and disclosure of your data as described in those policies.
13. Termination
-
We may suspend or terminate your access, cancel orders, or refuse service at our discretion, without notice, for any violation of these Terms, for security or legal reasons, or if you provide false or misleading information.
-
Upon termination, your rights to access and use the Site will cease immediately, but sections of these Terms (e.g. limitation of liability, indemnification) will survive termination.
14. Dispute Resolution & Governing Law
-
These Terms shall be governed by and construed in accordance with the laws of [State, e.g. Tennessee], without regard to conflict-of-law principles.
-
Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall, to the extent permitted by law, be resolved by binding arbitration (or in small claims court if eligible), rather than in court.
-
You agree to submit to the personal jurisdiction of the state or federal courts located in [County, State] for any matters not subject to arbitration.
15. Changes to Terms
We may revise or update these Terms from time to time (for example, to comply with legal changes or add new features). The revised version will be posted on the Site with a new “Last Updated” date. Your continued use of the Site after that constitutes your acceptance of the new Terms.
16. Severability & Waiver
-
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary and the remaining provisions will remain in full force and effect.
-
No waiver of any term or breach will be deemed a further or continuing waiver of that term or any other term unless expressly stated in writing.
17. Notices
-
We may deliver notice to you via email or by posting on the Site.
